New Medical Board Rules Effective February 28

Respiratory Care

Amended and new rules

The amended and new respiratory care rules in Chapter 4761, Ohio Administrative Code, are related to regulatory Board consolidation legislation that went into effect in January 2018. Changes in Ohio law, as well as consistency with the Medical Board’s existing processes for other licensee types, necessitated the rule changes.

Rescinded rules

Many respiratory care rules were rescinded because they duplicate, or are different from, existing Medical Board rules in areas such as the disciplinary administrative hearing process, personal information systems, criminal record checks, rulemaking, and board operations. As the complementary step to rescinding these rules, new rule 4761-15-01 incorporates respiratory care licensees into the Chapter 4731 Medical Board rules in various subject areas.
