Medical Board Responds to Governor’s Working Group Report
The State Medical Board of Ohio is grateful for the input and insight of Governor DeWine’s workgroup. The Strauss Investigation Working Group conducted a thorough and fair review of the board processes. We value the working group’s recommendations and appreciate the time, perspective, and expertise of the members.
The State Medical Board of Ohio's investigation of sexual misconduct complaints has substantially advanced since the tragic misconduct of Richard Strauss. We have streamlined the complaint intake process and now triage alleged sexual boundary violations with the highest priority. Investigations are more survivor-focused, more psychologically minded, and take advantage of the research that has been done in this area. As recommended in the report, staff and board member training will continue.
In addition to implementing recommended process and procedural changes, the board will continue to make operational improvements to better protect the victims of predator physicians. Medical Board members and staff look forward to reviewing the report in-depth and continuing to implement changes that will make us an even more effective regulatory board, supporting our crucial mission of protecting the health and safety of patients in Ohio.

September is National Recovery Month |

This month marks the 30th anniversary of Recovery Month. It celebrates the millions of people living in recovery from mental illness and substance use disorders.

Governor Mike DeWine created the RecoveryOhio initiative to coordinate the work of various state resources and the RecoveryOhio Advisory Council to provide recommendations and support for individuals with mental illness and/or substance use disorders for all Ohioans.

Reminder - October 1 Renewal Deadline
Physicians, Massage Therapists, and Cosmetic Therapists with a last name beginning with T - Z must renew their licenses by October 1, 2019. If your license is not renewed by that date, your license expires and you cannot practice. Physicians with an expired license will be unable to log on to OARRS.
Renew your license online at eLicense.ohio.gov. If you have not previously logged in to eLicense, a short “how-to” video is available through the Renew a License link on the Medical Board’s homepage.
Do not wait until the last minute to renew. By doing so, you assume the risk that the eLicense site may not be available and you may not be able to complete your renewal. Inability to access the site will not be an excuse for failure to renew timely. Therefore, we advise that you renew well before the deadline so that we have sufficient time to resolve any technical difficulties you may encounter.

A public hearing on proposed rules for PA requirements applicable to accessing and clearing youth athletes to return to play following a concussion and new, amended and rescinded rules for dietitians will be held on October 2 at 1:30 p.m. in the Lobby Hearing Room, Rhodes State Office Tower, 30 E. Medical Board Seeks to Contract with Victim Coordinators
The Victim Coordinator position will be a resource for the overall coordination of internal and external communications related to that investigation in partnership with board investigators and enforcement attorneys, law enforcement agencies, and the Attorney General Office and other prosecutor’s offices. The Victim Coordinator will provide trauma informed, emotionally safe communications to the victim while coordinating the victim’s participation in a board investigation.The Victim Coordinator will work under the direction of the Deputy Director of Investigations, Compliance, Enforcement, and Standards Review (ICES) or their designee to provide continuity and support functions to victims involved with a State Medical Board of Ohio investigation. Qualifying Conditions Update
The State Medical Board of Ohio’s Medical Marijuana Expert Review Committee met in August to further discuss autism spectrum disorder and anxiety as additional qualifying conditions. The board could then vote as early as September 11 to add or reject the conditions. If approved, these additions to the qualifying conditions will be added to the Ohio Administrative Code and updated on medicalmarijuana.ohio.gov.
By the Numbers
Ohio dispensaries began selling medical marijuana to patients and caregivers in January. To date, there are 29 dispensaries operating. Total product sales through September 1 is $23.5 million with 2,791 pounds of plant material and 68,197 units of manufactured product.
As of July 31, the Ohio Medical Marijuana Control Program reports:
- 551 Physicians with a Certificate to Recommend (CTR)
- 50,623 Recommendations
- 53,082 Registered patients
- 3,432 Patients with Veteran Status
- 2,042 Patients with Indigent Status
- 271 Patients with a Terminal Diagnosis
- 30,284 Unique patients who purchased medical marijuana (as reported to OARRS by licensed dispensaries)
- 3,998 Registered Caregivers

Board Seeks Subject Matter Experts
The State Medical Board of Ohio has been tasked with reviewing the petitions to add qualifying medical conditions to the Ohio Medical Marijuana Control Program (OMMCP). The board is currently seeking qualified subject matter experts to review the materials submitted in support of these petitions.
The next period for petitions of proposed diseases or conditions will be November 1, 2019, to December 31, 2019, with the review by subject-matter experts immediately to follow.
Pursuant to Ohio Administrative Code 4731-32-05, the petition must detail:
(1) The name and contact information for the person submitting the petition;
(2) The specific disease or condition requested to be added as a qualifying condition;
(3) Information from experts who specialize in the study of the disease or condition;
(4) Relevant medical or scientific evidence pertaining to the disease or condition;
(5) Consideration of whether conventional medical therapies are insufficient to treat or alleviate the disease or condition;
(6) Evidence supporting the use of medical marijuana to treat or alleviate the disease or condition, including journal articles, peer-reviewed studies, and other types of medical or scientific documentation;
(7) Letters of support provided by physicians with knowledge of the disease or condition. This may include a letter provided by the physician treating the petitioner, if applicable.
The subject matter expert shall render a written opinion on the suitability of medical marijuana for the proposed disease or condition within 45 days following receipt of the materials to be reviewed. Board personnel will communicate instructions to the expert as to the format of the report. We anticipate the report from a subject matter expert to be 2-5 pages in length.

Following receipt of this information, your name will be added to our list of subject matter experts. When the board receives a petition matching your background, experience, and specialty, board personnel will contact you with further details.
